Este livro procura apresentar as dificuldades que os PROCONs enfrentam na implementação de instrumentos de defesa coletiva, em decorrĂȘncia das divergĂȘncias paradigmĂĄticas existentes entre o Direito e as polĂticas pĂșblicas consumeristas. Constatou-se que dos 91 PROCONs municipais catarinenses, apenas trĂȘs manejam açÔes civis pĂșblicas. Dados que servem como indĂcios da existĂȘncia de dificuldades na implementação de instrumentos de defesa coletiva. Sob o enfoque do liberalismo social e do mĂ©todo hipotĂ©tico-dedutivo, defende-se a hipĂłtese de que boa parte das dificuldades enfrentadas pelos PROCONs na implementação destes instrumentos decorra de divergĂȘncias existentes entre os diferentes paradigmas que fundamentam o Direito brasileiro, com foco ainda individualista, pois formado na Modernidade, sob a influĂȘncia do paradigma newtoniano, e as polĂticas pĂșblicas de defesa do consumidor, com carĂĄter coletivo, uma vez que formadas na crise da Modernidade e do paradigma newtoniano.
