"Há um interesse público de que as relações jurídicas obrigacionais sejam cumpridas espontaneamente, e, caso isso não aconteça, que então sejam satisfeitas pela força coativa da tutela jurídica estatal sobre o patrimônio do devedor inadimplente.
No momento em que o corpo do devedor é substituído pelo seu patrimônio na respondência pelo inadimplemento da obrigação, nasce a regra geral de que todo credor comum tem, no patrimônio do devedor, a "tranquilidade", a "segurança", a "garantia" de que, se ele inadimplir a prestação, será o seu patrimônio que responderá pelos prejuízos daí decorrentes.
O patrimônio do devedor passa a ser, na estrutura da relação jurídica obrigacional, a garantia geral de todos os credores comuns. É a lei que cria, para todos os credores comuns, uma garantia patrimonial geral. É o patrimônio do devedor que serve de garantia para o credor receber o valor em dinheiro correspondente aos prejuízos decorrentes do inadimplemento".
