De los delitos y de las penas (1764), representó puntos de vista oficiales de la Ilustración en el terreno jurídico con gran influencia en las reformas penales posteriores. Escrita con 26 años de edad, se publica en forma anónima, luego cinco ediciones aparecen en Italia. En París, en 1776, la primera traducción con siete ediciones en el mismo año demuestran su repercusión en Francia. Se tradujo a veintidós idiomas, entre ellos, alemán, inglés, holandés, griego y ruso en 1803 y más de diez traducciones al español. Las ideas trasmitidas están vigentes aún y otras son aspiraciones, entre ellas, lo relativo a las penas, su relación con el ius puniendi, la esclavitud perpetua que sustituye la pena de muerte valorizando al castigo, el necesario esclarecimiento de los delitos con la prontitud de las penas como freno de estos.
