O presente trabalho trata de uma análise geral a respeito dos aspectos dogmáticos e estruturais do sistema funcionalista teleológico desenvolvido por Claus Roxin e as críticas decorrentes à luz do paralelo realizado com o sistema finalista de Hans Welzel. Além disso, analisa-se questões relacionadas ao bem jurídico e os aspectos éticos sociais; a teoria da imputação objetiva como mudança de eixo da análise do tipo subjetivo no tipo objetivo; a questão da ação nos dois sistemas; a política criminal e as estruturas lógico-objetivas; a insignificância e a adequação social; a questão da responsabilidade e a culpabilidade, sob uma visão crítica do ponto de vista finalista em relação ao funcionalismo de Roxin, e muito mais. Ao final, concluímos qual o sistema que mais se adequa ao Direito penal constitucional alinhado ao Estado Democrático de Direito sob o âmbito da Constituição da República de 1988.
